How is the attorney’s fee determined?
The scope and amount of the attorney’s fee can be agreed upon in a contract between the attorney and the client. In the absence of such an agreement, the minimum fees applicable to specific legal services are determined by the Attorneyship Minimum Fee Tariff in force at the relevant time.
Why is a Power of Attorney required, and how can it be issued?
In order to initiate or pursue legal proceedings, a person seeking legal assistance must issue a power of attorney to the attorney.
For clients residing in Turkiye, powers of attorney must be issued through a notary public.
For those living abroad, powers of attorney may be issued at the relevant Turkish consulate.
What is mediation as an alternative dispute resolution method?
Certain legal disputes can be resolved through mediation, either before initiating court proceedings or during the course of litigation. Mediation is applicable in private law disputes over which the parties have the freedom to exercise their rights of disposition — such as employer-employee conflicts, claims for compensation or debts between individuals, landlord-tenant disputes, and inheritance or real estate-related matters.
In addition to our legal representation and consultancy services, our firm also provides professional mediation services.
Why consider arbitration as an alternative dispute resolution method?
Arbitration is a faster, more confidential, and flexible form of adjudication, in which parties resolve their disputes not through state courts but through arbitrators of their own choosing.
International arbitration is particularly preferred in commercial and investment disputes involving parties from different jurisdictions.
When can I apply for mediation?
When a dispute arises between you and the other party, you can go to a mediator before applying to court or arbitration, or you can go to a mediator after filing a lawsuit with the court.
Is it mandatory to hire a lawyer?
Under Turkish law, it is mandatory to be represented by a lawyer in situations where the suspect, defendant, or complainant is underage, mentally or physically incapable of defending themselves, or is deaf and mute; as well as cases where the charge carries a minimum sentence of more than five years. In such cases where hiring a lawyer is mandatory, if the individual cannot afford legal representation, a lawyer may be appointed free of charge by the bar association. Outside of these circumstances , there is no obligation in Turkish Law for the parties to be represented by a lawyer, every individual has the right to represent themselves in court. However, considering the legal system is a set of rules based on complex laws, regulations, and legislations that contain a lot of details, we strongly recommend seeking professional legal assistance to avoid the risk of losing your rights due to procedural errors or lack of legal knowledge.
Do you provide both legal representation and mediation services to the same person/legal entity?
Within the scope of the principle of neutrality and independence, we do not provide mediation services to clients to whom we offer legal representation, nor do we offer legal representation to parties for whom we have served as a mediator. Our approach is not based on material interest but on a firm commitment to ethical principles.
